Convictions Overturned In Simon Marketing Sweepstakes Case A federal appeals court has erased the convictions of four men found guilty of fixing sweepstakes held on behalf of McDonald’s. The 11 th U.S. Circuit Court of Appeals said that no conspiracy existed among the men. The sweepstakes was being administered by Simon Marketing, which had been owned by Counselor Top 40 distributor Cyrk Inc. (asi/173519). The men whose convictions were overturned - George Chandler, Jerome Pearl, John Henderson and Kevin Whitfield - can not be retried, says The Associated Press. The person convicted of leading the scheme, Jerome Jacobson, security director for Simon, was not covered by the appeal and has been sentenced to three years in prison.

Spike Flips Wig At SAAGNY Event Counselor Publisher Emeritus Marvin Spike literally flipped his wig at a rollicking roast for Walter Schatz, executive director of Specialty Advertising Association of Greater New York last week. Spike presented one of his spare toupees to Schatz at the event, and there’s reportedly pictures floating around of the two hair-challenged executives.

Good Strong Industry Ink As noted on eWeek.com, Formost Inc. (asi/196373) placed 494 th in Interactive Week’s Interactive 500, with about $700,000 worth of online revenue – the only promotional products firm on the list.
Meanwhile, across the world, the New Zealand Herald ran a lengthy piece discussing promotional products, including national and international figures, with mentions of specific products, the Australasian Promotional Products Association, Maria Carlton and David Blaise’s book on promotional products, and distributor High Impact.

Illinois AG Sues Kool Over Hip-Hop Campaign, Radio Giveaway The Illinois attorney general has sued Brown and Williamson saying its hip-hop-themed promotion for Kool cigarettes is targeting children when it uses merchandise giveaways. The attorney general, Lisa Madigan, says that the tobacco company is using a free compact radio and interactive CD-ROMs to appeal to young people. Promotional products with cigarette logos were nixed by the well-known 1998 settlement, but tobacco companies have continued to offer proofs of purchase for unimprinted merchandise and other product giveaways.
Obituary Matt Langley, vice president of Ultra Marketing Inc. (asi/348051), recently passed away playing hockey. He was 34, and had joined the firm in 1992. He’s survived by his wife Nadine; his parents, Chuck and Marty; a sister, Amanda; and a brother, Clay.
